Terms and Conditions

TERMS AND CONDITIONS FOR CHARTER JUNKS HK’s SERVICE
Charter Junks HK has made all the necessary arrangements to comply with the relevant Hong Kong Marine Department regulations. Our junks have Class IV certification and are insured in accordance with Hong Kong law.
In order to prevent miscommunication, and ensure there are no disagreements on the day of your junk trip, we have constructed some clear guidelines below. Please review these Terms and Conditions and if you have any queries, or wish us to clarify any issues, please do not hesitate to contact us at info@charterjunkshk.com.

ORGANISERS RESPONSIBILITY
By agreeing to these terms the junk organiser of a charter is responsible for informing all their guests of the following terms.

By paying a HK$4,000 deposit to secure a booking you are agreeing to these terms and conditions in their entirety. For any unforeseen emergencies related to change of booking date, a minimum of 3 weeks notice (high season – April – Oct) and two weeks (low season – Nov – March) prior to the booking date is required. If it’s not within this period, the deposit amount will be forfeited.


CAPTAIN
The Captain has the sole right for decisions made onboard the junk and may issue directions to staff and guests should a situation arise.
Following reckless or dangerous behaviour by any of the junk guests, the Captain reserves the right to return to the pier and the charter is deemed to have been terminated.
The Captain reserves the right to control the music level on board.
In the event of dangerous weather during the charter, the Captain reserves the right to return to the pick-up point or a suitable alternative dock.
When extra guests who are part of an all-inclusive package board, the Captain reserves the right to only leave the pier once full payment for guests has been paid.

FOOD AND DRINK
At the end of the junk trip, upon arrival at the drop-off point, passengers are not permitted to remove any leftover food or beverages.
Infants (0-3 years) are not catered for.
Charter Junks HK are not responsible for guests with allergies. Every care will be taken to remove menu items when notified in advance but Charter Junks HK cannot guarantee traces of nuts, eggs, wheat, etc. are not present. If the junk organiser knows of a guest(s) with a severe allergy we suggest the junk party bring their own food. Please note junk staff do not know what ingredients have been used during the preparation of your food and will therefore be unable to answer any questions you may have about a dish and its ingredients.


DAMAGE
The junk trip organiser is responsible for any damage caused to the junk by them or their guests and are liable for any repair costs.

BOAT CAPACITY
The number of guests who board a junk cannot exceed the legal limit/licence capacity Poppy 35 pax and Kitty 35 pax and the Captain will refuse to sail out. In the case more guests wish to board than were originally confirmed and paid for, any additional guest will be charged the relevant rate per person, regardless of whether or not food and/or drinks are sufficient. This is payable in cash before the junk can set off to its destination. The junk trip organiser is responsible for arranging payment.

SAFETY AND RESPONSIBILITY
Junk guests are solely responsible for their own personal safety and that of any property they bring aboard. Bringing illegal substances or using illegal substances during the junk trip is strictly prohibited. Smoking of any substance anywhere below deck is not permitted. For your own safety and the safety of others, Charter Junks HK recommends passengers only wear appropriate, flat-soled footwear whilst on board the junk and remain seated at all times whilst the junk is sailing. Furthermore, Charter Junks HK recommends no dancing, running, jumping or diving off the upper deck whilst the junk is sailing. There is a strict no swimming policy at nighttime. Charter Junks HK takes no responsibility for damages, theft or personal injuries during boarding, the duration of the junk trip, at the time of disembarkation, or at any time thereafter. When a Typhoon Signal 3 is hoisted or a Red Rainstorm Warning is issued, the charter will be automatically postponed. The junk organiser and their guests must be fully aware of the potential dangers on board a junk including tripping hazards, moving parts and obstacles and the potential dangers of exposure to the sun and consuming alcohol.

GOVERNING LAW
The junk is only to be used for leisure purposes only and not for any commercial or illegal use. The junk must also remain within Hong Kong territorial waters at all times.

COVID-19
In the event that the restrictions imposed by the Government in response to Covid-19 result in a charter becoming prohibited on the originally scheduled departure date, Charter Junks HK will arrange to reschedule the charter to a subsequent departure date based on the following terms:

  • If the original departure date is on weekday, the rescheduled day must also be on a weekday. If the original departure date is on the weekend, the rescheduled day must also be on the weekend.

  • Any difference in the junk charter fee between the rescheduled day and the original charter date will not be refunded, for example weekday and weekend prices.

  • Should a reschedule of a charter be necessary, the new departure date must be within 6 (six) months of the original charter date. If the junk charter organiser has not rescheduled a new date within this 6 (six) month timeframe, then the junk charter organiser will be deemed to have forfeited 100% of the charter fee.

  • Unless otherwise provided under these terms and conditions, we will not accept any refund request.

ADDITIONAL CARGO OR EQUIPMENT
Should the junk organiser wish to bring additional cargo or personal equipment onboard for the junk charter such as sound systems, Charter Junks HK must be informed at least 14 days prior to the charter date and permission must be granted in writing by Charter Junks HK.
Charter Junks HK accepts no responsibility for such items and is not liable for any damage or loss to any such items which may occur as a result of being brought aboard for the junk charter. Under no circumstances may the junk’s sound system be used in conjunction with DJ equipment. If a DJ is operating on the junk then all relevant equipment must be provided by the junk organiser.

RENTAL TIME
The standard rental time is 7 (seven) hours for a day trip and 4 (four) hours for an evening trip (to be completed before 12 midnight). The maximum travel time between pick up and drop off cannot exceed 3 (three) hours. Any additional travel over the allotted time will be subject to an extra surcharge and fuel levy.
Junk guests are assumed to embark and disembark at the same pier point. If special arrangements need to be made, they should be discussed and agreed prior to departure with Charter Junks HK and may incur additional costs. Please confirm your route and itinerary with Charter Junks HK prior to departure.

ACTS OF NATURE
If during a junk trip there is a change in weather which poses a safety risk, the Captain of the junk is obliged to immediately return the vessel to the point of pick-up or to the nearest appropriate place of shelter, in accordance with the Marine Department Ordinance.


WEATHER
The junk rental date cannot be changed for rain, typhoon signals T1 or T2, thunder warning, monsoon warning, yellow or red rain warnings or any other untoward weather conditions. If the junk organizer cancels the junk trip due to the weather, any monies already paid will be forfeited. However, if a typhoon signal T3 (or higher) or a black rainstorm warning is in force in the 2 (two) hours before the appointed pick-up time of the booked junk trip, Charter Junks HK will automatically postpone the junk trip to a later date with agreement with the junk organiser. If a typhoon signal T3 or higher is hoisted or a black rainstorm warning is issued during the junk trip, the Captain is obliged to immediately return the vessel to the point of pick-up or to the nearest appropriate place of shelter, in accordance with the Marine Department Ordinance. Charter Junks HK must emphasise that no compensation will be made for any “unused” time.

 

BOAT SELECTION

While we endeavour to assign you, your preferred boat at the time of booking, this is not guaranteed. We need to factor in boat availability, repairs/breakdown, location pickup/drop off, route viability and fuel charges and at times we may need to reassign boats to meet our operational needs.


MECHANICAL FAILURES
If, due to mechanical reasons, the junk is not able to sail prior to the booking date, Charter Junks HK will try to provide a replacement junk similar to the one booked. However if no other boats are available, Charter Junks HK will inform the junk organiser immediately and will agree to either (i) change the junk trip departure date with agreement with the junk organiser or (ii) refund any monies already received. If mechanical problems occur during the junk trip on the way to the confirmed destination, the Captain will provide best efforts to carry the passengers to either the destination or to the most convenient drop-off point. If the junk has already been out for more than half of the booked time or has already reached its destination, no compensation in terms of a rebooking will be available. If compensation time is applicable, a rebooking of the junk trip can only be used on a regular day (no special holidays), or the junk organiser can choose to have a proportional amount of the fee returned.

INSURANCE
Charter Junks HK has third-party insurance coverage in accordance with Hong Kong’s regulations. Please be aware, however, that this insurance does not provide cover for damage to personal property or to individuals in many circumstances (e.g. personal accident/injury). If you wish to comprehensively protect yourself and your guests Charter Junks HK recommends that you arrange insurance that is specifically intended for this purpose (e.g., one-day safe local travel accident insurance). Charter Junks HK’s liability for any loss or damage suffered by you or your guests shall not exceed the total charter fee of the relevant junk charter.

CHILDREN AND PETS
Children and pets are the sole responsibility of their guardians/owners and children 14yrs or below must wear lifejackets at all times while on the junk.

PHOTOS
By chartering with Charter Junks HK, you acknowledge that photos may be taken of the trip/event and you consent that these photos may be used for promotional purposes by Charter Junks HK. Please inform Charter Junks HK if you do not agree to this.


By filling out Charter Junks HK’s Booking Form you, the junk organizer, has confirmed that you have read and understood our Terms and Conditions.
